Here are some conditions that bind a lease and lessor

The Transfer of Property Act confers some rights and liabilities in the event of a property being leased out.
Here are some:

  • If,during the continuance of the lease, any accession is made to the property, such accessionis deemed to be comprised in the lease itself.
  • In case any material part of the property is wholly destroyed or rendered substantially and permanently unfit for the purpose for which it was let, then the lease will be void at the option of the lessee.
  • In case a less or neglects to make any repairs, which he is bound to make to the property even after reasonable notice, the lessee may undertake the repairs himself, and deduct the expense of there pairs with interest from the rent,or he may recover it from the lessor.
  • If a lessor neglects to make any payment, which he is bound to make, the lessee may make the payment himself, and deduct it with interest from the rent,or recover it from the lessor.
  • Even after the determination of the lease, the lessee may remove all things, which has attached to the earth, provided he is in possession of the property. However, he should leave the property in the state in which he received it.
  • In case a lease of uncertain duration is determined, he is entitled to all the crops planted or sown by the property when the lease determines.
  • In case the lessee transfers, mortgages, or sub-leases the whole or any part of his interest in the property(in accordance with the lease agreement), he will not cease to be subject to any of the liabilities attached to the lease.
  • A lessee is bound to disclose to the less or any fact as to then a ture or extent of interest which materially increases and of which the less or is not aware.
  • A lessee is bound to pay at the proper time and place, the rent to the lessor or his agent.
  • A lessee is bound to keep, and on the termination of the lease to restore the property, in as good a condition as it was in at the time when he was put in possession. This may be subject to the changes caused by reasonable wear and tearorirresistible force. He needs to allow the lessor and his agents, at all reasonable times during the term, to enter upon the property and inspect the condition, and given otice of any actor default on the part of the lessee, his servants or agents, he is bound to make it good with in three months after such not ice has been given.
  • In case the lessee becomes aware of any proceeding to recover the property or of any encroachment madeup on or any interference with the lessor’s rights concerning the property,he is bound to give due notice of it to the lessor.A lessee is bound to use the property as a person of ordinary prudence would use it as if it were his own. He must not use the property for a purpose other than that for which it was leased.
  • A lessee must not, without the lessor’s consent, build on the property any permanent structure.
  • On the determination of the lease, the lessee is bound to put the lessor in to possession of the property.
